Hemp-Derived THC: Is It Legal?

The short answer is yes, the hemp-derived THC in the new Cosmic Gummies is 100% Federally Legal and Farm Bill Compliant. However, some states decided to crack down on THC, even if it’s under the 0.3% Federal Law. Let’s dig in.

Hemp-Derived THC & The 2018 Farm Bill

In 2018, the Farm Bill was updated, and hemp was legalized at the federal level. The only real stipulation is that hemp plants, extracts, and any product created from hemp cannot exceed more than 0.3% delta-9-tetrahydrocannabinol.

Here’s the official language:

For the purposes of this new part, and as defined in the 2018 Farm Bill, the term “hemp” means the plant species Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. Delta-9 tetrahydrocannabinol, or THC, is the primary intoxicating component of cannabis. Cannabis with a THC level exceeding 0.3 percent is considered marijuana, which remains classified as a schedule I controlled substance regulated by the Drug Enforcement Administration (DEA) under the CSA.  

Although the maximum amount of hemp-derived THC is 0.3%, they never put a milligram cap of THC per serving or package. They also didn’t include any derivatives of THC like delta-8-THC, synthetic forms of THC, nor did they include the non-intoxicating form of THC, its precursor, THCA – Delta-9-Tetrahydrocannabinolic-Acid!

Hemp-Derived THC: Where we don’t ship!

Unfortunately, some states decided to overpower the overlords by creating new laws around THC and its counterparts.

Minnesota put a 5 mg cap of THC per gummy. Idaho enforced a 0% THC law. Hawaii is OK with medical marijuana and hemp with THC, but hemp CBD products must be produced and manufactured by licensed THC facilities. 

Math is fun!

Interestingly, as brilliant or sinister as the folks in government who wrote the Farm Bill may be, they never considered how much a little gummy weighs or how many milliliters are in a 12-ounce beverage. 

At a glance, 0.3% of anything seems like a minimal amount, but when you’re dealing with an incredibly potent compound like hemp-derived THC, 0.3% can be pretty significant.

Let’s do some fun stoner math.

  • All of the gummies we produce here at Future Compounds weigh 5 grams.
  • 5 grams = 5,000 milligrams.
  • 5,000 mg x 0.3% or .003 = 15 mg

Based on the 0.3% law, we can infuse 15 mg of hemp-derived THC into our gummies. But that’s cutting it close to popping hot, so we decided to formulate our gummies to 0.2%, with 10 mg of hemp-derived THC.

  • 5,000 mg x 0.2% of .002 = 10

Now, many people tend to use the word “loophole” when discussing the fact that someone can get totally blasted on a Federally legal Farm Bill-compliant hemp-derived THC product. We disagree with this idea because it’s not a loophole – it’s the law!

For years, people have been able to get their hands on potently dosed hemp-derived THC products. We aren’t the pioneers in offering hemp CBD products that also include a healthy dose of THC. However, we are proud to say that to the best of our knowledge, we did produce the most potently dosed hemp gummy on the market.

The Cosmic Gummies have 150 mg of total cannabinoids. The All Day gummies have 10 mg of hemp-derived THC and 140 mg of CBD. The All Night gummies have 10 mg of hemp-derived THC, 120 mg of CBD, and 20 mg of CBN. The Watermelon Blast flavor is sweet and delicious, AND you can taste the potency.
